MichaelKrisa.com’s Contest provides the opportunity to show and tell your video story regarding the “Contest Theme”, for the best realtor videos showcasing both the homes and the agents.
The determination of the winner will be done in 2 parts; the first part by social sharing on Facebook, YouTube, and various web sites (subject to the Official Rules of this Contest), followed by evaluation within MichaelKrisa.com to determine the winners.
TERMS & CONDITIONS
Your engagement in the (the “Contest”), including your submission of a short video (2-5 minutes preferred) shall be considered to be your complete acceptance of the terms and conditions set out in these Official Rules by MichaelKrisa.com at Concession 4 NDR RR# 3 Hanover, Ontario N4N 3B9 Canada (the “Company”) and its agents and representatives.
- Eligibility.Eligibility to enter in the Contest is available to all realtors, and to all persons and entities over age 18 (“Eligible Entrant”). Entry begins with an invitation for recipient to participate in the Contest (the “Invitation”). Entry in the Contest is only open to Eligible Entrants at least eighteen (18) years of age at time of entry. Employees and relatives of employees of the Company and any entities affiliated or related to the Company are not eligible to enter the Contest.
- How to Enter
2.1 How to Enter Contest. In order to enter the contest and be eligible to receive a prize, an Eligible Entrant must complete submit his or her video story at Michael Krisa’s Facebook Page, https://www.facebook.com/michael.krisa and Youtube https://www.youtube.com/user/realestateunplugged/about (the “Contest Sites”). Only Video Submissions shall be eligible to receive a prize. An Eligible Entrant that submits a Video shall be referred to as an Entrant. Only one entry per Invitation and per Entrant is permitted. Submissions must completed from between 12:00:01 August 1, 2015 (Pacific time) through 11:59:59 p.m. (Pacific time) on August 31, 2015 (the “Entry Period”). All Video Submissions become the property of the Company and none will be returned. Company reserves the right to disqualify any Entrant who tampers with or attempts to tamper with the entry process, voting process, the Contest Site or violates these Official Rules.
- Video Submissions.
3.1 Subject Matter Requirements. The submitted video should show the realtor’s approach to video like showing a home, describing the community, a personal message, or by answering the question: ”What makes you the realtor to choose in your area?” The Video Submission should be 2-5 minutes in length.
3.2 Submissions. Company reserves the right to edit, alter or modify Submissions to the Contest for pacing, clarity, and/or editing without notification or consent from Entrants. If the Submission appears to comply with the Contest standards, the entry will be posted to the Contest Site, YouTube, Facebook, and other social media networks for voting and a confirmation notice will be sent will be sent to the Entrant.
Video Submissions cannot include any content which would reasonably be understood to be defamatory, threatening, distasteful, racist, unlawful or otherwise objectionable to Company, at Company’s sole judgment. Company reserves the right, in its sole and absolute judgment, to disqualify any Submission that does not comply with the Official Rules, contains third party content, or is unsuitable for the Contest for any reason.
- Representations Regarding Video Submissions; Grant of Rights.By entering a Video Submission with the Contest you represent and warrant to Company that (i) your Submission is your own original work and that you have the sole right to submit it to the Contest; (ii) your Submission does not violate in any way rights of third parties, including but not limited to copyright and other intellectual property rights; (iii) your Submission does not violate any applicable laws; (iv) you have obtained all necessary licenses or permissions from all appropriate third parties required for the production and submission of the Entry in the Contest and use by Company as contemplated in these Official Rules; (v) the posting and/or display of your Entry on the Contest Site or other use by Company will not violate the intellectual property rights or rights of publicity or rights of privacy of any third parties or otherwise breach any provision of any applicable law or regulation; (vi) Company has your irrevocable permission for the posting of your first name and last name, your city and state and any and all information included in your Submission in connection any permitted use of your Submission; (vii) use and posting of the Submission or any part of the Submission provided by you to Company in any manner in connection with the Contest or as otherwise permitted by these Official Rules is and will be without any compensation, regardless of whether your Submission is the winning Submission; and (viii) you have obtained irrevocable full and informed consent of any third party whose image, likeness and speech appears in your Submission. By entering your Video Submission to the Company in connection with the Contest you agree to and thereby waive any and all moral rights that exist in your Submission to the Contest and any derivative works made from it.
All Entrants hereby grant to Company an everlasting, royalty-free, assignable, irrevocable, license to use, replicate, modify, publish, broadcast, translate, present, display, sublicense and exercise all copyright and other intellectual property and personal rights with respect to each Submission worldwide and/or to include a Submission in other works in any media now known or later created, anywhere. Each Entrant agrees and grants Company permission to make available and display/perform and otherwise distribute Entrant’s Submission in all media in perpetuity without compensation. Except where legally prohibited, submission of a Submission into this Contest constitutes permission for Company to use the entrant’s name, address (city and state) and story, in print, broadcast media or any media, forever, in any manner Company deems appropriate in connection with promoting the this Contest and Company’s business, without further compensation.
In the event that an Entrant breaches any of his or her representations, warranties or undertakings to Company, Company shall be entitled to and may seek indemnification from Entrant for recovery of all legal fees, damages, claims and other expenses that may be incurred by Company or its affiliated entities as a result of such breach.
- Voting. Social sharing will commence on the later of the first posting of Submissions for voting by Company at the Contest Site or social media from 12:00:01 August 1, 2015 and will conclude at 11:59:59 p.m. (Pacific time) on August 31, 2015 (the “Voting Period”). Only one vote per person and per IP address is allowed. Company may reject votes in violation of these rules. If a mechanical malfunction, computer virus or other condition causes the Contest to be incapable of completion, Company may terminate further entries or further voting and determine the winner from the entries available and votes cast at the time the termination occurs.
- Prize.There will be three (3) winners. After verification, and subject to compliance with the Official Rules, the Winning Video Submission that receive the most social sharing (Likes, comments, etc.), delivers the best message and video for the realtor, and by Company review during the Voting Period as determined by Company, will receive an iPad (the “First Prize”), Taxes on the Prize and expenses related to acceptance, delivery and use of the Prize, are the sole responsibility of the Prize Winner. Any lost or stolen Prize will not be replaced by Company.
- Notification of Winners.After the conclusion of the voting period the Company will determine Winners on or about September 3, 2015. Company will notify each Winner via telephone and/or e-mail on or about the week of September 3, 2015. Such notified person, at his or her sole discretion, may disclaim a Prize by not claiming such Prize or by not completing and returning to Company, Company’s Eligibility and Publicity Release within fourteen (14) days of attempted notification. In the event that any Winner elects to disclaim the Prize Company will determine Submission received the next highest score in the category and will notify the Winner as set forth above. This process will be repeated until such time as a Prize Winner completes and returns to Company the Company’s Eligibility and Publicity Release within fourteen (14) days of attempted notification. Except where prohibited by law, the Prize Winner further grants to the Company the right to use such Prize Winner’s name, photograph, voice, likeness and city of residence for purposes of advertising or promoting and publicizing the efforts and activities of the Company and the Contest without further consideration and to release his or her full name and city and state of residence to persons requesting the names of the winner of the Contest. Non-compliance or the return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.
- Privacy.All information submitted as part of this Contest will be treated in accordance with Company’s Privacy Policy. By submitting information in connection with any portion of the Contest, each participant agrees to receive contest materials from the Company. Participants may opt-out from receiving Company’s contest materials in accordance with Company’s Privacy Policy.
- General.Company shall not be responsible for any technical malfunctions of the telephone network, computer on-line system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any property damage, personal injury or death. Company reserves the right to change these terms and conditions at any time and at its sole discretion. Company assumes no responsibility for lost or late entries or for incomplete computer transmissions or technical failures, including but not limited to computer viruses.
- Release and Limitations of Liability.By joining in the Contest, Entrants agree to release and hold harmless Company, its Affiliates, Subsidiaries, Advertising and Contest Agencies, and their Officers, Directors, Employees and Agents (The Parties to the Contest) from and against any claim or cause of action arising out of participation in the contest, or receipt and/or use of any Prize, including Property Damage, Personal Injury or Death. Each Participant further agrees that in any Cause of Action, the Contest Parties’ Liability will be limited to the cost of participating in the contest. The Contest Parties shall not be liable for any attorney’s fees, punitive, direct or indirect damages and each Entrant waives the right to claim any Damages.
- Dispute Resolution.Except where prohibited by law, each participant agrees that any and all disputes, claims and causes of action arising out of or in connection with the Contest shall be resolved individually, without resort to any class action, exclusively by the courts located in the judicial district including the province of Ontario, Canada. All issues concerning the construction, validity, and interpretation of these Official Rules shall be governed by and construed in accordance with the laws of the province of Ontario, Canada (and Canadian laws, as applicable), without giving effect to any choice of law or conflict of law rules that would result in the application of the laws of any jurisdiction other than the laws of the province of Ontario, Canada and applicable Canadian laws.
